Pulled Over Driving While Intoxicated (D.W.I.) is a serious issue with social, legal, and financial implications. Individuals convicted of violating New York State laws governing DWI should expect to receive severe penalties. Based on recent statistics, including substantial numbers of fatalities, injuries, and property damage resulting from driving while intoxicated, many advocacy groups are calling for even tougher DWI laws.

"In 2007, nearly 13,000 people were killed in drunk driving related crashes." *

Arrested Even under the best circumstance a DWI conviction in New York can be a very costly and disruptive experience. Depending upon the severity of the offense, the individual may even find themselves facing incarceration.

The Penalties for DWI convictions vary, depending upon the offense. Applicable fines for alcohol offenses range anywhere from $300 to $10,000. In addition to fines, a number of court surcharges may be assessed to each offense and typically range from $260 to over $500.

Apart from the above referenced fines and surcharges, a $750.00 Driver Responsibility Assessment is charged by the Department of Motor Vehicles, in addition to typical fees for re-issuing a license.

Sold Eligibility for a conditional license requires a fee of $200 to $225 to be paid for attendance of the NYS Drinking Driver Program. If referred for alcohol and substance abuse evaluation, each offender is accountable for the cost of treatment not covered by insurance. Each DWI Offender will also need to obtain Automobile Insurance from the risk pool. The premiums paid by this group are typically 3 times that of typical drivers.

In addition to fines, surcharges and varied fees, individuals charged with certain drug and/or alcohol related driving offenses may be subject to incarceration.
